Internet Law
Today, a company’s Internet presence plays an increasingly vital role in its ultimate business success. Cantor Colburn offers clients a full range of strategic services designed to support their digital identities by establishing, maintaining, protecting, and enforcing their online trademark rights, copyrights, and domain names. Well-versed in evolving policies and standards, we are able to help our diverse group of clients successfully navigate this crucial area of intellectual property law. Our internet and domain name counsel includes:
Domain Name Selection, Registration, and Acquisition
The choice of a domain name is the critical first step in establishing and protecting online IP rights. We help clients to create domain names that will achieve their objectives and help them secure and register such names. Cantor Colburn also helps clients with the acquisition of domain names.
Domain Name Development and Protection
A website address is an integral part of an organization’s brand identity. Cantor Colburn is highly experienced in helping clients develop viable domain name strategies that meet their individual needs. In addition, Cantor Colburn strategizes with clients on how to most effectively protect their domain name from bad actors.
Domain Name Disputes
Cantor Colburn attorneys regularly assist clients facing issues related to their businesses, including cybersquatting, typosquatting, and pagejacking. The Uniform Domain-Name Dispute-Resolution Policy (UDRP) offered through the Internet Corporation for Assigned Names and Numbers (ICANN) is an expedited and less-costly administrative proceeding that allows trademark owners to challenge an infringing domain name registration. Cantor Colburn is experienced in obtaining relief for clients seeking to protect their trademark rights through UDRP proceedings. Cantor Colburn attorneys regularly handle UDRP proceedings before agencies such as the World Intellectual Property Office and the National Arbitration Forum. Cantor Colburn also assists trademark owners through use of other legal avenues to enforce clients’ IP rights, namely the Anti-cybersquatting Consumer Protection Act.
Website Agreements
A website and/or mobile application, armed with thorough business practices and policies, is integral to limiting a business against liability. These business practices and policies are communicated to users through a series of agreements on a business’ website and/or mobile application. They include: a set of terms and conditions (also known as terms of use, terms of service, and end-user agreements), privacy policies, and cookie policies. Cantor Colburn helps clients create and develop these agreements for clients’ websites and/or mobile applications.
Social Media Trademark Issues and Claims
The social media landscape is rapidly evolving. Such explosive growth in social media usage has generated a host of potential trademark issues. At the forefront of this burgeoning field, Cantor Colburn is well equipped to guide clients through a shifting legal environment by offering up-to-date counsel on everything from trademark protection for hashtags, usernames, and brand identities to compliance with social media policies. We safeguard our clients’ social media presences, protecting them against the unauthorized use of their marks. Cantor Colburn also assists clients with trademark and copyright protection in the online marketplace against counterfeit sellers and users.
