COVID-19: USPTO and Copyright Office Announce Deadline Extensions

The USPTO and Copyright Office have announced certain deadline extensions due to the ongoing COVID-19 emergency. Under the emergency guidance, patent prosecution filings and payments, PTAB filings, and trademark registration filings and payments initially due on or between March 27 and April 30, inclusive, are extended for 30 days from their initial due date—except for replies in patent prosecution to pre-examination notices and payment of patent maintenance fees, in each case by entities lacking small entity or micro entity status. TTAB deadlines may be extended upon a motion requesting an extension. Copyright registration timing provisions may be extended in some circumstance either 30 days or two months, upon a requisite showing of disruption and depending on the severity of the applicant’s disruption.
